1. About Us

ScrubHood is operated by ScrubHood LLC, a Wyoming limited liability company (“ScrubHood,” “we,” “us,” or “our”), located at 30 N Gould St, Ste N, Sheridan, Wyoming 82801. We operate the website at www.scrubhood.com (the “Site”). By accessing or using the Site, you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Site.

2. Eligibility & Acceptance

The Site is intended for users aged 18 and over. By using the Site, you confirm you meet this requirement.

If you create or use an account on behalf of an organization (for example, a staffing or travel nursing agency), you represent that you have authority to bind that organization to these Terms, and “you” includes that organization.

3. Use of the Site

You agree not to:

  • Use the Site for any unlawful purpose
  • Copy, reproduce, scrape, or redistribute Site content without permission
  • Attempt to interfere with the Site's security or functionality
  • Misrepresent your identity, credentials, or affiliation in any way
  • Submit false, misleading, or fraudulent reviews or data submissions
  • Submit any patient-identifiable or otherwise confidential information

We reserve the right to suspend or restrict access to the Site at our discretion, with or without notice.

4. Content and Information; No Professional Advice

All content on the Site is provided for general informational purposes only. Nothing on the Site constitutes professional, medical, legal, financial, or career advice. You should not rely solely on Site content when making decisions — always seek independent professional advice where appropriate.

Hospital quality data, safety grades, infection rates, and pay or wage information (including pay calculator estimates) are aggregated from public sources, government data, and third-party providers. This information is provided “as is” for general reference only. Always verify current details directly with the relevant facility, agency, or employer before making decisions. We make reasonable efforts to keep content accurate and current but make no representations or warranties of any kind, express or implied, as to its accuracy, completeness, or reliability.

Certain third-party ratings displayed on the Site (for example, hospital safety grades) are displayed under license or applicable use terms from their respective rights holders and may not be copied, redistributed, or used commercially without separate permission from that rights holder.

5. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Provide accurate information when registering and keep it up to date.

6. User-Generated Content (Reviews & Submissions)

By submitting a review, rating, comment, scrub-color or parking submission, or other content (“User Content”), you grant ScrubHood a non-exclusive, worldwide, royalty-free, sublicensable, transferable license to host, use, reproduce, display, and distribute that content on the Site and in our marketing.

You confirm that any review reflects your own genuine, first-hand experience, and that it does not include patient-identifiable information, named individual coworkers or patients, or confidential employer information. See our Review Guidelines for details.

We may moderate, decline to publish, or remove any User Content that violates these Terms or our Review Guidelines. We may correct formatting but will not edit the substance of a review. We do not independently verify the truth of User Content; it reflects the views of its author, not ScrubHood, and we are not liable for it.

“Verified Nurse” or similar badges reflect a good-faith identity check (for example, name-matching against public NPI records) and are not a guarantee of identity, licensure, or credentials.

7. Copyright / DMCA Notice

We respond to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act (DMCA). Notices should be sent to our designated agent, Copyright Compliance Department, at 30 N Gould St, Ste N, Sheridan, Wyoming 82801, or legal@scrubhood.com, and must include the information required under 17 U.S.C. § 512(c)(3).

8. Affiliate Links

Some links on the Site are affiliate links, meaning we may earn a commission if you click through and make a purchase, at no additional cost to you. Affiliate links are identified at the point they appear on the Site in accordance with applicable disclosure requirements, including US Federal Trade Commission (FTC) guidelines on endorsements and testimonials.

Our editorial content is not influenced by affiliate relationships. We only link to products or services we believe are relevant and useful to our readers.

9. Recruiter and Third-Party Employment Links

The Site may include links to job listings, recruiters, agencies, or third-party employment platforms (“Recruiter Links”). These links are provided for convenience only. ScrubHood is a media and listings platform — we are not a recruitment or staffing agency and do not act as an intermediary between you and any employer, agency, or recruiter.

We are not responsible for the accuracy or availability of any job or pay-package listing, the conduct of any recruiter, agency, or employer, or any outcome arising from your use of a Recruiter Link. Any arrangement you enter into with a recruiter, agency, or employer is solely between you and that third party.

10. Third-Party Links Generally

The Site may contain links to other third-party websites. These links are provided for your convenience and do not constitute an endorsement of those sites or their content. We have no control over third-party sites and accept no responsibility for their content, privacy practices, or availability.

11. Agency Accounts & B2B Services

Agencies may claim, verify, and manage a profile on the Site, and may purchase paid subscription tiers for enhanced placement, analytics, or lead-notification features (see the Site for current tiers and pricing). Profile claims are subject to verification, such as matching a work-email domain or manual review.

ScrubHood is a media and listings platform. We are not, and do not act as, a staffing or employment agency, and we do not guarantee any placement, lead volume, applicant, or hiring outcome. Fees charged to agencies are for advertising, listing, and platform access only, and are never contingent on, or calculated as a percentage of, any placement or hire.

Agency accounts are subject to a separate Agency Terms or Order Form presented at sign-up, which is incorporated into these Terms by reference and controls in the event of a conflict.

12. Payment, Billing & Cancellation

Paid subscriptions (including nurse premium and agency tiers) are billed in advance on a recurring basis (monthly or annual) through our payment processor, Stripe. By subscribing, you authorize recurring charges until you cancel.

You may cancel at any time through your account dashboard; cancellation takes effect at the end of the current billing period. Fees already paid are non-refundable except where required by law or expressly stated at the time of purchase. We may change our pricing with advance notice; continued use of a paid feature after a price change takes effect constitutes acceptance of the new price.

13. Intellectual Property

All Site content — including text, graphics, logos, compiled datasets, and software — is owned by or licensed to ScrubHood and is protected under US and international copyright and trademark law. You may not reproduce, distribute, or create derivative works from Site content without our prior written permission. This does not apply to underlying public-domain source data (for example, CMS data), which remains subject to its original public-domain status.

14. Disclaimer of Warranties

The Site and all content are provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by applicable law.

15. Limitation of Liability

To the maximum extent permitted by law, ScrubHood will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of income, revenue, data, or opportunity, arising from your use of, or inability to use, the Site. Our total liability for any claim relating to the Site will not exceed the greater of (a) $100, or (b) the amount you paid us in the twelve (12) months before the claim arose. Nothing in these Terms limits any liability that cannot be limited under applicable law.

16. Indemnification

You agree to indemnify and hold ScrubHood harmless from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Site, your User Content, or your violation of these Terms.

17. Privacy

Our Privacy Policy explains how we collect, use, and store information gathered through your use of the Site, including analytics and cookies. By using the Site, you consent to our Privacy Policy.

18. Term & Termination

We may suspend or terminate your access to the Site at any time, with or without notice, for violation of these Terms or for any other reason at our discretion. You may stop using the Site or delete your account at any time. Sections that by their nature should survive termination — including Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, and Dispute Resolution — will survive.

19. Dispute Resolution; Arbitration Agreement & Class Action Waiver

Except for disputes qualifying for small claims court, you and ScrubHood agree to resolve any dispute arising out of or relating to these Terms or the Site through binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual action in small claims court.

You and ScrubHood each agree that any arbitration will be conducted on an individual basis only, and not as a class, collective, or representative action. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing legal@scrubhood.com with your name and account email and a clear statement that you opt out.

20. Governing Law & Venue

These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law principles. Subject to the Arbitration Agreement above, you agree to the exclusive jurisdiction of the state and federal courts located in Wyoming for any dispute not subject to arbitration.

21. General Provisions

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force. These Terms are the entire agreement between you and ScrubHood regarding the Site, superseding any prior agreements. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign these Terms freely in connection with a merger, acquisition, or sale of assets.

22. Changes to These Terms

We may update these Terms at any time. The updated version will be posted on this page with a revised date. Your continued use of the Site after any changes constitutes acceptance of the updated Terms. We recommend reviewing these Terms periodically.
